September 12, 2023: We filed a lawsuit about mortgage fraud against Fairway and William B. Murphy in Worcester District State Court.
November 3, 2023: Honorable Judge R. Pellegrini reviewed our lawsuit against Fairway & Murphy and found evidence:
September 23, 2024: Judge James G. Haddad dismissed our case because we did not ask for "monetary damages" for our suffering. He did not allow us to present our evidence about mortgage fraud to Jury Trial. Judge Haddad denied our request to amend our complaint with money damages. We immediately filed an Appeal in Massachusetts Appellate Division. 21 months later, our appeal is still pending. Today, not one Judge has affirmed Judge Haddad's decision.
April 16, 2025: While our Appeal is pending, Fairway scheduled Foreclosure Sale #1 of our home on May 15, 2025.
May 12, 2025: We filed Chapter 13 Lawsuit to stop Foreclosure Sale while our Appeal is pending. Judge Elizabeth D. Katz was assigned to our case. Fairway cancelled the Foreclosure Sale #1.
October 22, 2025: Fairway Attorneys requested Judge Elizabeth D. Katz to allow them sell our home immediately while our Appeal is pending. Judge Katz covered-up Fairway's mortgage fraud and demanded we immediately surrender our home.
October 27, 2025: We filed an appeal of Judge Katz's Chapter 13 order to Judge Denise J. Casper in U.S. District Court (Boston).
January 7, 2026: Fairway scheduled Foreclosure Sale #2 to sell our home on January 28, 2026 while our two Appeals are pending. We filed an Emergency Motion requesting Judge Denise J. Casper to cancel the sale while our two Appeals are pending. But Judge Casper never responded! Then Fairway cancelled Foreclosure Sale #2.
February 27, 2026: Fairway Attorneys Sarah A. Billeri and Brian Kiser filed their own Chapter 13 Appeal Briefs. They covered-up mortgage fraud by completely ignoring Judge Pellegrini's order about Fraud, Deceit, Intentional Misrepresentation, etc.
July 2, 2026: Judge Denise J. Casper protected her colleague Judge Elizabeth D. Katz and covered-up mortgage fraud. Judge Casper wrote 13-page order dismissing our Chapter 13 Appeal without mentioning Judge Pellegrini's Order, Judge Haddad's Order or our pending Appellate Division Appeal. Judge Casper also did not address several critical issues.
According to law records, several Appeal Judges in other cases have overruled Judge Denise J. Casper.
